LICENSING, CHANGE AND TRANSFER OF OWNERSHIP

Patents, models and trademarks are exclusive rights which can be transferred, conferred in companies, inherited, licensed, etc., in the same way as registered movable property.

The regulations in force provide for that the exploitation of an invention, a design or a trademark (industrial property rights) can be carried out either directly by the proprietor or indirectly through a third party, by entering licensing, merchandising, franchising, co-branding agreements etc. In addition, there is provided for the possibility to transfer, even only partially, rights relating to the aforementioned industrial property rights.

All deeds which modify or transfer patent, models and trademark real rights shall be recorded at the Offices where the intellectual property right is registered.

Likewise, all changes relating to the proprietor of the intellectual property right, for example changes in the company name or address should be recorded in order to ensure the correct enforcement of the relative rights.

Our firm offers assistance when it comes to notifying the Offices in the event of changes in the data of registered proprietors (for example changes in company name or changes in address), transfer of ownership, grant of licenses, by filing applications for recording or annotation at the designated offices such as the Italian Patents and Trademarks Office (UIBM), the European Patent Office (EPO), the European Intellectual Property Office (EUIPO), the World Intellectual Property Organization (WIPO) and at the individual national Trademarks and Patent Offices through our agents.
